RE: Informational Report
KITCHEN—The
district was served with an Administrative Complaint Case Number 2010035076 on
July 19, 2010 from the Dept. of Business and Professional Regulation (DBPR). This relates
to the issue of the Trailer Estates kitchen.
Through various inspections and discussions this
spring with the inspector, Victoria Bagley, DBPR, we
were informed that if we could legally show we were a mobile home park, then
the license would not be required as long as we were serving to our residents
and their guests.
As we are working with the DBPR
attorney to resolve this Administrative Complaint, we are gaining additional
information and clarification of the issues.
The current issue is whether our kitchen needs a "food
establishment" license when serving to the mobile
home park residents and their guests.
Additionally is the issue of the advertisement/sale of food.
In order to handle this complaint, the district attorney
will be contacting the Board and will provide updated information. A PP34 has been submitted to schedule this as
an agenda item on the August 2, 2010 Board Meeting.
Inspection, July 1, 2010—The report from the Department of Business and
Professional Regulation (DBPR) indicates only 3 areas
of concern: a) no plan review, b) no license, and c) food
handlers working in the kitchen need training. During this particular
inspection two residents, Peg Durham and Lenora Neal, were cooking. Because
they are both registered by the state as “certified kitchen managers”, the
inspection report did not show a 4th area of concern/deficiency that
would have otherwise been indicated. Our kitchen meets all other aspects
necessary for a “food establishment” license.
LAWSUIT—The
hearing scheduled for early August has been cancelled. An agreed upon order has been filed with the
court regarding the District’s 2nd Motion for Partial Summary Judgment. A copy of this can be
obtained through the District Records Custodian. The trial is still on the
docket for the October 4, 2010 trial period. (The Tribune was printed and this article
could not be updated with this information.)
VACANCY— We have a vacancy on
the board for the Continuing Recreation Trustee/Marina Trustee. Information
about the duties of that Trustee can be found in PP40—Trustee Duties, available
in the District Office. The vacancy will be advertised on the District bulletin boards sometime in September. Interviews/appointment (see PP3) will be
scheduled for October when a quorum is anticipated.
ELECTION—There are five board openings in the upcoming election this
December, 2010. We are looking for property owners to consider running. Don’t forget to stop in at the Manatee County
Supervisor of Elections Office to get your materials. His office is located at 600 301 Blvd. W,
PUBLIC RECORDS and SUNSHINE LAW—The next workshop for Trustee(s)/Trustee Elect(s) will be
December 2010. This will be conducted to
provide information to the new Board members, along with providing a
refresher/reminder to current Trustees. Public records are those materials regarding
the business of Trailer Estates and must be provided to the District
Office/Public Records Custodian even when those materials are received at your
home, through personal email, seminar or elsewhere.
THANK YOU to Andy Fiordimondo for his
work with the District as a member of ARC.
He has resigned from the committee effective July 26, 2010 as he is
moving from Trailer Estates.
MEETINGS—Meetings for October will be scheduled for 7:30 p.m.
since the trial period is during our normal meeting times.
