Meeting called to order: By
Martha Brauer at 9:40 a.m.
ROLL CALL: Martha appointed Margo Cushman acting
secretary. Martha Brauer, Margo Cushman,
Harry Fitzpatrick, Fred Hoch, Janet Jones, John Vander Molen were present. Pam Cole, Gail Opper, Joe Salerno absent.
APPROVAL OF MINUTES:
Motion to approve the minutes
of May 18, 2009, as corrected made by John Vander Molen and seconded by Margo
Cushman. Motion carried 6-0. Motion to approve the minutes of May 28,
2009, as corrected made by John Vander Molen and seconded by Fred Hoch. Motion carried 6-0. Motion to approve the minutes of June 1, 2009
as corrected made by Janet Jones, Margo Cushman seconded. Motion carried 6-0.
CORRESPONDENCE: All correspondence is in the office and
available for public viewing.
REPORT OF TREASURER: The treasurer was not present to give report.
APPROVAL OF BILLS:
Martha Brauer made a motion to
pay Joe Salerno’s attorney fees of $4.950.00 for the Denson-Smith lawsuit. Joe signed a trustee agreement. Harry Fitzpatrick seconded the motion. No discussion. Motion carried 6-0. Martha Brauer made a
motion to pay Mary Lou McNulty’s attorney fees of $4,431.68 for the
Denson-Smith lawsuit. This does not
include the copying fees for the attorney.
Mary Lou signed a trustee agreement.
Harry Fitzpatrick seconded motion.
No discussion. Motion carried
6-0. Margo made a motion to pay $34.55
for copy fees to Mary Lou McNulty’s attorney. Motion seconded by Janet
Jones. No discussion. Motion carried 6-0.
INFORMATIONAL REPORTS OF
TRUSTEES:
John Vander Molen reported on
the problem of channel 16. You only get
channel 16 if you have a digital television or a digital converter box. Bright House is working on resolving this
problem.
Margo Cushman announced that
there would be no Pot Luck in June, July, August or September due to the lack of
participation. She also reported that
the dance in May went well. The next
dance will be June 27,2009. Coffee Break
will be June 20, 2009. Ken Meierjurgen will be
speaking about the CERT
program. Margo also gave the Bingo
Report.
Harry Fitzpatrick reported on
the fence between Desears and Trailer Estates.
He is still trying to contact the owner to get information. He will keep trying. No news so far.
Fred Hoch commented on keeping
your grass cut and the fruit off the ground.
Janet Jones reported that 12
cards were sent and there were 2 deaths in May.
Martha Brauer reported on
garbage collection before 7:00 a.m. The
company was contacted and made aware of the problem. She was told that they
would correct the problem. Martha also
reported that Rusty Plumbing Co. will be doing sewer repairs on 69th
Avenue and it would be temporarily closed on June 23-25, 2009 and Canada Blvd
would be closed on June 30 – July 1, 2009.
Martha also announced that Election Information for 2009 is available. There will be 4 vacancies. Election will be held December 8, 2009. Handbook for candidacy is available in the
office. Share is discontinued for the
summer. You may get information on Bay
Shore Garden’s Church cite by contacting Sue Piper at 755-3503. Martha also discussed issues with
website. The shortcuts to the website
may be found in the TE Tribune or on channel 95. Martha also wanted to recognize the CERT
group, which was reported on channel 7 news.
She also recognized Deloris Black, a seamstress for the Apollo 11 moon
landing flag. The next meeting will be
June 18, 2009 at 9:00 a.m. This is a
special meeting. There will be a
workshop on June 22, 2009 to discuss the Marina lease, By-law revisions will be
outlined in a time line, and P16 does not address actual cost and needs to be
work shopped.

John Vander Molen reported on
the ARC meeting. Next ARC meeting is
June 12, 2009.
RESIDENTS COMMENTS: There were no resident comments.
OLD BUSINESS:
Letter read from Gail Opper to
be included in Shade meeting via phone.
Fred Hoch made a motion to allow Gail to participate in shade meeting my
phone. Margo Cushman seconded. No
discussion. Motion passed 6-0. Letter read from Joe Salerno to be included
in Shade meeting via phone. Harry made a
motion to allow Joe to participate in shade meeting by phone. Seconded by Margo Cushman. No discussion. Motion carried 6-0. Letters attached.
The private attorney-client
session to discuss potential settlement or strategy sessions related to
litigation expenditures in the case of Smith versus Trailer Estates Park and
Recreation District. This attorney
client session is estimated to last approximately one hour, and the following
people will be in attendance. Martha
Brauer, Margo Cushman, Harry Fitzpatrick, Fred Hoch, Janet Jones, Gail Opper,
Joe Salerno, John Vander Molen, Mark P. Barnebey, Esq. The meeting was
adjourned to the private Shade meeting.
The meeting will last approximately 1 hour and 45 minutes per Mark
Barnebey.
Meeting was re-called to order
at 1:12 P.M.
Martha Brauer made a motion to
ratify any ordinary bills taken care of at Special Meeting held May 28,
2009. John Vander Molen seconded. No discussion. Motion carried 6-0.
Martha Brauer made a motion to
ratify the motion made at the Special Meeting held May 28, 2009 that due to
extra ordinary conditions Gail Opper may be present by phone for this special
meeting. Fred Hoch seconded the motion. No discussion. Motion carried 6-0. Margo Cushman made a
motion to ratify the motion made at the Special Meeting held May 28, 2009 that
the park pay the $4,500 in attorney fees pending proper documentation for Mary
Lou McNulty. Janet Jones seconded. No
discussion. Motion carried 6-0. John Vander Molen made a motion to ratify the
motion made at the Special Meeting held May 28, 2009 that moved to continue
with Bright House as stated in contract, extension of 3 years. Seconded by Fred Hoch. No discussion. Motion carried 6-0. Margo made a motion to
ratify motion made at Special Meeting held May 28, 2009 for a resolution to
engage 09-09 in mediation. Janet Jones
seconded motion. No discussion. Motion carried 6-0. Margo made a motion to ratify a motion made
at the Special Meeting held on May 28, 2009 to adopt resolution 09-03 to ay for
mediation. Fred Hoch seconded
motion. There was a discussion regarding
the ratification due to the lack of a quorum of voters on this resolution.
Margo withdrew her motion and Fred Hoch withdrew his second. A motion was made by Fred Hoch to ratify a
motion made at the Special Meeting on May 28, 2009 to approve revised version
of ARC P 7. John Vander Molen seconded
the motion. No discussion. Motion carried 6-0.
Directors and Officers
insurance was discussed. Scott Rudacille
stated that he felt there was nothing that alarmed him in this policy. Fred
Hoch made a motion to approve the purchase of the policy from Travelers
Insurance Company for $6,851.02 upon completion of review from attorneys. Janet seconded the motion. No further discussion. Motion carried 6-0.
The deed restriction violation
at 6508/6515 Nebraska was discussed.
Martha read a letter from Rude & McClusky. Janet Jones made a motion to request the
attorney to verify compliance in this matter with a sworn affidavit from the
owner. Fred seconded the motion. No further discussion. Motion carried 6-0.
NEW BUSINESS:
Martha discussed the Boat Slip
Lease payment changes. An outside renter
wants to pay for 6 months instead of a year.
This was not a motion just discussion.
It was referred to work shop.
John Vander Molen motioned to allow the non-resident boat slip renter to
be able to pay for 6 months of rental until the lease matter is resolved. Margo seconded the motion. No further discussion. Motion carried 6-0.
CLUBS AND ORGANIZATIONS: No reports
TRUSTEE COMMENTS:
Martha Brauer announced the
Special Meeting on Thursday, June 18, 2009 at 9:00 A.M. There will be a shade meeting as part of this
special meeting. After the Shade meeting
there will be a public hearing to consider mediated settlement in the matter of
Smith and Denson vs. Trailer Estates Par and Recreation District (2008A11315)
