Pam Cole opened the meeting at
9:30 A.M.
INFORMATIONAL REPORTS OF
TRUSTEES:
As treasurer, Pam Cole
reported a checking account balance of $14,602.33 and a Money Market Account
balance of $1,147,159.04. Pam also
reported on budget performance for June. Pam also gave days of the week that
she could be reached in the office.
Margo Cushman read an
informational report from Martha Brauer.
See attached report.
Pam Cole then read a legal
notice from the State of Florida regarding the kitchen inspection and reply
from Kirk Pinkerton, TE District attorney regarding July 1 inspection.
ANNOUNCEMENTS OF CLUBS AND
ORGANIZATIONS:
Peg Durham, 6908 Tarpon Lane,
Announced that Cooks Night Out will be held August 5,
2010 and tickets went on sale today at the post office.
DISASTER PLAN: Pam Cole discussed the Districts Disaster
Plan. Pam also informed the residents
need to plan ahead for there personal safety.
GENERAL LEDGER PROBLEM
CORRECTIONS: Pam discussed a Journal
Entry error in one of the Districts accounts.
The error has been corrected. She
stated she has not found out how the error occurred but assured the residents
that the matter was under control.
SPA UPDATE: Pam informed the residents about the bids of
$14,000 - $15,0000 for fixing the spa safety issue to
bring our spa up to code.
SMALL HALL AIR CONDITIONER
PROBLEM: Pam informed the residents that
the small hall air conditioner was repaired at minimal cost.

Discussed fines, license, and insurance regarding kitchen issue. She also would like to know about the
accounting error. She also informed the
board of disaster locations.

RE: Informational Report
KITCHEN—The
district was served with an Administrative Complaint Case Number 2010035076 on
July 19, 2010 from the Dept. of Business and Professional Regulation (DBPR). This relates
to the issue of the Trailer Estates kitchen.
Through various inspections and discussions this
spring with the inspector, Victoria Bagley, DBPR, we
were informed that if we could legally show we were a mobile home park, then
the license would not be required as long as we were serving to our residents
and their guests.
As we are working with the DBPR
attorney to resolve this Administrative Complaint, we are gaining additional
information and clarification of the issues.
The current issue is whether our kitchen needs a "food
establishment" license when serving to the mobile
home park residents and their guests.
Additionally is the issue of the advertisement/sale of food.
In order to handle this complaint, the district attorney
will be contacting the Board and will provide updated information. A PP34 has been submitted to schedule this as
an agenda item on the August 2, 2010 Board Meeting.
Inspection, July 1, 2010—The report from the Department of Business and
Professional Regulation (DBPR) indicates only 3 areas
of concern: a) no plan review, b) no license, and c) food
handlers working in the kitchen need training. During this particular
inspection two residents, Peg Durham and Lenora Neal, were cooking. Because
they are both registered by the state as “certified kitchen managers”, the
inspection report did not show a 4th area of concern/deficiency that
would have otherwise been indicated. Our kitchen meets all other aspects
necessary for a “food establishment” license.
LAWSUIT—The
hearing scheduled for early August has been cancelled. An agreed upon order has been filed with the
court regarding the District’s 2nd Motion for Partial Summary Judgment. A copy of this can be
obtained through the District Records Custodian. The trial is still on the
docket for the October 4, 2010 trial period. (The Tribune was printed and this article
could not be updated with this information.)
VACANCY— We have a vacancy on
the board for the Continuing Recreation Trustee/Marina Trustee. Information
about the duties of that Trustee can be found in PP40—Trustee Duties, available
in the District Office. The vacancy will be advertised on the District bulletin boards sometime in September. Interviews/appointment (see PP3) will be
scheduled for October when a quorum is anticipated.
ELECTION—There are five board openings in the upcoming election this
December, 2010. We are looking for property owners to consider running. Don’t forget to stop in at the Manatee County
Supervisor of Elections Office to get your materials. His office is located at 600 301 Blvd. W,
PUBLIC RECORDS and SUNSHINE LAW—The next workshop for Trustee(s)/Trustee Elect(s) will be
December 2010. This will be conducted to
provide information to the new Board members, along with providing a
refresher/reminder to current Trustees. Public records are those materials regarding
the business of Trailer Estates and must be provided to the District
Office/Public Records Custodian even when those materials are received at your
home, through personal email, seminar or elsewhere.
THANK YOU to Andy Fiordimondo for his
work with the District as a member of ARC.
He has resigned from the committee effective July 26, 2010 as he is
moving from Trailer Estates.
MEETINGS—Meetings for October will be scheduled for 7:30 p.m.
since the trial period is during our normal meeting times.

This is in response to the July 11, 2010 letter that Mrs. Lew sent to the Board and I feel that I must correct some of her egregious misinformation. I will give you a copy of this response so that under no circumstances can my words be misquoted or misinterpreted.
1. She raises the question regarding the bill for the water fountain in the woodshop.
Fact: The water fountain in the woodshop was offered to the club as a budgeted item. They opted to fund the fountain themselves. I thought that was a wonderful gesture on their part, well in keeping with their traditions of service to this community. Why she now questions allowing the employees to use that fountain is beyond my understanding. I cannot believe that the members themselves would ever wish to deny the employees, working outside in all kinds of weather the use of a water fountain situated in an air conditioned building built and maintained by the taxpayers no matter who paid for a water fountain.
2. She states also that JVM (John VanderMolen) is back in court spending TE money. That is an attorney decision, not ours. She goes on to question why our home is in a trust. If she had asked me, I could have told her it has been in a trust for over 14 years now.
3. At a fire hall gathering awhile ago, I understand that she openly made a statement to several people that she has someone watching our home in order to report to her just who comes to call and how long they stay. If this is still going on, please let me know, and I'll make certain to leave my blinds open and the lights on to assist you in your surveillance.
4. Now I would like to address the kitchen incident that occurred July 1 at Cook's Night Out.
In the many court documents is an E-mail from Mary Lou Smith to Tom Featheringill in which she states that she and her sister Sharon Denson had talked to Pam Cole and felt that Pam was "easily trainable". Which I felt was a rather insulting statement.
When the state inspector showed up on Cook's night out and was in discussion in the kitchen with Margo Cushman, a trustee, Pam Cole came rushing in to the kitchen. Frankly, due to the aforementioned E-mail I was alarmed. To this day I have no idea what Pam was thinking, was it pure carelessness on her part or an effort to implicate the park or Margo in a sunshine violation. So I intervened and reminded her of the potential violation. She did leave.
Interestingly in her deposition under oath she accused trustees of violations of the sunshine law because she saw them speaking to one another. Well, over 80 people saw her possibly discussing a matter that will eventually come to the board for a vote. If I hurt her feelings by intervening...... so be it. The
community is more important to me than her feelings.
As a former college nursing instructor and former
supervisor in a state psychiatric hospital I am deeply concerned about
Mrs. Lew's constant bullying, and harassment of this board and our employees.
While I
have pity for her and her obvious problems I am more concerned about the effect
her behavior has upon our community and our employees. I would hope that at
some point her family will recognize the harm she is doing to herself and
others and get her the help she so obviously and desperately needs.
I know the park is unable to address this problem but one solution that possibly could help would be for the video club to stop filming meetings. I realize this would inconvenience a number of our residents but it would certainly eliminate our having to witness the constant repetitive micro-management and harassment of the board to the relief of many. As for her rudeness to employees, I have no solution to offer other than words of consolation to them.
I would like to suggest that if she is going to continue to write complaining and harassing letters in order to formulate public records, that she brush up on the grammar and sentence structure in her letters. They certainly could be read more easily.
Final thought, a community is much like a hive of bees. There are workers and there are drones.. .they all buzz, but some are productive and others just buzz around contributing little or nothing but a lot of annoying noise. Thank you
