BOARD OF TRUSTEES MEETING

NOVEMBER 22, 2010

9:30 A.M.

The meeting was called to order at 9:30 a.m. by Chairman Martha Brauer.

 

ROLL CALL:  Martha Brauer, Pam Cole, Margo Cushman, Fred Hoch, Debra Hutchinson, Jim McIlveen, Gail Opper, Joe Salerno.  Absent:  Harry Fitzpatrick.

 

Due to the fact that a Litigation Assessment had been requested by the attorneys, Martha asked that the Board alter the agenda.  She requested the Board suspend Approval of Minutes, Report of Treasurer, Reports of Trustees, and Reports of Standing Committees.  The Board agreed.

 

APPROVAL OF BILLS

 

A motion was made by Pam, seconded by Joe, to pay Kirk Pinkerton $95,214.72 for a bill covering Oct. 1-26, 2010.  This bill includes pre-trial and trial services.  Motion passed, 8-0.

 

RESIDENTS COMMENTS:  None

 

Martha passed out copies of PP50 regarding emotional support animals and asked the Board to review it for the Nov. 29 meeting.  She also reported that a contract was sent to us twice from the Manatee County Elections Office but we got neither copy.  She explained that two people must be appointed to check voting machines for the election and approve absentee ballots as well as the election’s final results.  Martha chooses one person and the Board appoints the other.  Martha has selected Terry Neally, who held the position last year.  Martha suggested the Board consider Ed Neally for the other position.  He also did the job last year.

 

Fred asked if he should give copies of the ARC member duties to Board members.  Martha felt that should be done.  ARC wants to change the building permit to reflect the fact that ARC told a resident that he/she needs a county permit.  Martha felt, and the Board agreed, that this could place ARC in a situation that could make them liable.  Fred announced the pool will be closed Wednesday morning this week instead of Thursday morning due to the Thanksgiving holiday.  He reminded everyone that the kitchen was inspected and was given the okay to serve food for the shuffle tournament.

 

Joe announced that people should come to the Large Hall at 8 a.m. Saturday morning to decorate.

 

Margo stated that Bill Cottum had surgery today and is doing well.

 

Martha reminded residents that the office will close at noon on the Wednesday before Thanksgiving and that it will not be open Wednesday evenings as this was a trial period for November only.  Only five people came in during those evenings.

 

Pam announced that absentee ballots can be obtained at the Manatee County Elections Office as well as on your personal computer.

 

The District’s attorney Mark Barnebey requested a Litigation Assessment meeting in the case of Smith/Denson versus Trailer Estates.  He expected the meeting to last approximately 75 minutes.  Martha read the list of names of those who will be in attendance.

 

The Board went into session at 9:45 a.m. and returned at 11:13 a.m.  Mr. Barnebey announced that there is nothing to report.  The Litigation Assessment meeting was closed an the public meeting was reopened. 

 

RESIDENTS COMMENTS

 

Joe Langton, 2107 Ohio—He is concerned about the litigation and the upcoming election.  The election is not about issues but about how to resolve them.  We need to do the right thing.  He doesn’t want to take chances on anyone who supported the lawsuit.  If the Board were weak or cowardly, they would have settled.  The park would have paid the expenses of the plaintiffs and would have had legal scrutiny.  It would have brought more lawsuits in the future.  The Board has been very effective and has demonstrated they want to do the right thing.  He strongly recommends that the park elect not even one of the new candidates.

 

Bill Mumford, 1715 Iowa—Candidates Night videos will be shown on Channel 95.  The first part will be shown today and the second part will be shown tomorrow plus they will be shown at least two more times before the election.

CLUBS AND ORGANIZATIONS

 

Lenora Neal, 6619 CA—The Kitchen Bees are planning to have the Christmas Dinner for residents and their guests.  Four tickets will be allowed per residence.  Tickets are free.  The dinner will be held at 4 p.m., Dec. 25, in the Large Hall.

 

Margo:  The Beautification Committee will meet Wednesday, Dec. 8, from 11 a.m. to 1 p.m. in the Blue Heron Room.

 

The Yacht Club meeting will be held at 7:30 p.m. today in the Small Hall.  A speaker will talk on estuary.

 

ANNOUNCEMENTS

 

Jim:  We can operate our golf carts on Bay Drive to the mall and to the Oyster Bar.  We cannot operate them on the sidewalks.  Jim wants to alert residents about an incident that occurred in our park.  Tampa Signal—tied into ADT Alarm Systems and recommended by AARP—is selling home monitoring.  Their contract has small print and is very hard to read.  One of our residents is now liable for $36 a month for three years.  He changed his credit card number, but the bank said they can give the new credit card number to creditors.  Jim stated we need to be careful whom we deal with and don’t give our credit card information to anyone.

 

Pam:  You can’t put a “stop payment” on a debit card.

 

Joe:  At the Workshop on Nov. 29, Joe will discuss the key information he has gathered.

 

Martha:  The next meeting is Nov. 29 at 9:30 a.m.  The Board Meeting will be first followed by a Workshop.

 

Debbie:  Recycling went over well at the Coffee Break.  Within three weeks, we had three tons of things recycled.  She wants to thank everyone and said she will get more information about this to the residents.

 

            Martha:  Do we have to pay for roll offs?

 

            Joe:  We pay for roll offs.  In the new contract, Joe will try to get the recycling roll offs for free.

 

            Pam:  In all the time she has been treasurer, we have only paid for the roll offs one time.  We have never been charged for picking up paper.
